If Verve does not resolve your complaint, you may submit your complaint free of charge to the DMA, Verve’s designated independent dispute resolution provider.
Under certain conditions specified by the principles of the EU-U.S. Privacy Shield Framework, you may also be able to invoke binding arbitration to resolve your complaint. Verve is subject to the investigatory and enforcement powers of the FTC. If Verve shares EU Data with a third-party service provider that processes the data solely on Verve’s behalf, then Verve will be liable for that third party’s processing of EU Data in violation of the Principles, unless Verve can prove that it is not responsible for the event giving rise to the damage.
Residents of the European Economic Area (“EEA”) have the right to access the personal information that Verve maintains, and in some cases, may have the right to correct or amend information that is inaccurate or has been processed in violation of the Privacy Shield Principles, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated.
